Terms of Service
1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the Fictorium service, including the website at fictorium.net and your private writing instance (collectively, the “Service”), operated by Fictorium (“we”, “us”, “our”), a trading name based in Ireland.
By creating an account, joining the waitlist, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, and by our Privacy Policy. If you do not agree, you must not use the Service. You must be at least 16 years old to use Fictorium.
2. Description of Service
Fictorium is a web-based creative writing environment designed for fiction authors. Your subscription gives you access to a private, isolated instance that includes:
- A story and chapter editor
- Character profiles and relationship mapping
- World-building and lore wiki tools
- Timeline visualisation
- File and image storage for research material
Each user's instance is entirely isolated: your data lives in a dedicated database and file storage, separate from all other users.
Fictorium supports Model Context Protocol (MCP), which allows you to connect your own AI subscriptions (such as Claude) to your writing environment. Fictorium itself does not generate content, train AI models, or process data on behalf of any AI provider. Your use of any connected AI service is governed by that provider's terms and privacy policy.
3. Accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at [email protected] if you suspect any unauthorised access to your account.
You may not share your account with others or create multiple accounts for the same individual. Each account is personal and non-transferable.
You agree to provide accurate and complete information when creating your account and to keep it up to date. We may suspend or terminate accounts that contain false, misleading, or incomplete information.
4. Your Content and Ownership
You retain full ownership of all content you create, upload, or store within Fictorium — including stories, characters, world-building notes, lore entries, uploaded files, and any other creative material (“Your Content”).
We do not claim any ownership over Your Content. We do not read, sell, license, or use Your Content for any purpose other than operating the Service for you. We will never use Your Content to train AI models.
By using the Service, you grant Fictorium a limited, non-exclusive, royalty-free licence to store, host, and transmit Your Content solely to the extent necessary to provide the Service. This licence terminates when you delete your content or close your account.
You are solely responsible for Your Content. You represent and warrant that you own or have the necessary rights to Your Content, and that it does not infringe the intellectual property rights, privacy rights, or other legal rights of any third party.
5. Acceptable Use
You agree not to use the Service to:
- Upload, store, or transmit any content that is unlawful, defamatory, obscene, or that infringes any third party's intellectual property rights
- Distribute malware, spyware, or other malicious code
- Attempt to gain unauthorised access to other users' instances or to Fictorium's infrastructure
- Use the Service to conduct or facilitate any form of fraud, phishing, or spam
- Reverse engineer, decompile, or attempt to extract the source code of any part of the Service
- Use the Service in a manner that violates any applicable law or regulation
We reserve the right to investigate suspected violations and, where appropriate, to suspend or terminate accounts, remove content, or report activity to law-enforcement authorities.
6. Payment and Billing
Plans
Fictorium offers a free tier (“The Scribe”) and a paid subscription plan (“The Chronicler”) at €12 per month. The features available under each plan are described on our pricing page, which we may update from time to time.
Billing cycle
Paid subscriptions are billed monthly in advance. Your subscription renews automatically on the same date each month unless you cancel it before the renewal date. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period, and you retain access to the paid features until that date.
Payment processing
All payments are processed by Stripe. By providing your payment details, you agree to Stripe's terms of service. Fictorium never stores your full card number or financial credentials. You authorise us to charge your payment method for the applicable subscription fee on each renewal date.
Price changes
We may change our subscription prices. If we do, we will notify you at least 30 days in advance by email. The new price will apply at your next billing cycle after the notice period. If you do not wish to continue at the new price, you may cancel your subscription before the next renewal.
7. No Refunds and Right of Withdrawal
All payments for Fictorium subscriptions are non-refundable. Given the nature of the Service as immediately-accessible digital content, there are no partial-month credits or refunds for unused subscription time.
In accordance with Article 16(m) of EU Directive 2011/83/EU on Consumer Rights, the 14-day statutory right of withdrawal does not apply to digital content where performance has begun with your prior express consent and acknowledgment that you thereby lose your right of withdrawal. By clicking “Begin Epic Journey” (or equivalent) at checkout, you expressly consent to immediate access to the Service and acknowledge that you waive your right of withdrawal.
This does not affect your statutory rights in the event of a fault, service failure caused by Fictorium, or where required by applicable Irish consumer law. If you believe you have been charged in error, please contact [email protected] within 14 days of the charge.
8. Service Availability
We aim to keep Fictorium available at all times but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to scheduled maintenance, infrastructure issues, or circumstances beyond our control. Where possible, we will provide advance notice of planned downtime.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time. We will give reasonable notice of material changes where practicable. Fictorium is not liable for any loss or inconvenience resulting from temporary unavailability.
9. Termination
You may close your account at any time from your account settings. Upon closure, your data will be scheduled for permanent deletion within 30 days, as described in our Privacy Policy. If you have a paid subscription, it will not be refunded for any remaining period.
We may suspend or terminate your account, with or without notice, if we have reason to believe you have violated these Terms, engaged in fraudulent or abusive behaviour, or where required by law.
Upon termination for any reason, your right to use the Service immediately ceases. Sections 4 (content ownership), 7 (no refunds), 10 (intellectual property), 11 (limitation of liability), and 14 (governing law) survive termination.
10. Intellectual Property
The Fictorium name, logo, website design, user interface, and underlying software are the intellectual property of Fictorium and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our express written permission.
Nothing in these Terms transfers any intellectual property rights from Fictorium to you, except for the limited licence to use the Service in accordance with these Terms.
11. Limitation of Liability
To the maximum extent permitted by Irish and EU law, Fictorium's total liability to you for any claims arising from or related to the Service shall not exceed the total amount you have paid to Fictorium in the 12 months preceding the event giving rise to the claim, or €100, whichever is greater.
Fictorium shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including (without limitation) loss of data, loss of profits, loss of business opportunity, or loss of creative work — even if we have been advised of the possibility of such damages.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable Irish or EU consumer law.
12. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or free of harmful components. This disclaimer does not affect your statutory rights as a consumer under Irish law.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes — including changes that affect your rights or obligations — we will notify you by email and display a prominent notice within the Service at least 14 days before the changes take effect. The 'last updated' date at the top of this page reflects the current version.
Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of those Terms. If you do not agree to the updated Terms, you must stop using the Service before they take effect and may close your account.
14. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Ireland, without regard to its conflict-of-law provisions. The courts of Ireland shall have exclusive jurisdiction to settle any dispute or claim arising from or in connection with these Terms or the Service.
If you are a consumer resident in another EU member state, you may also have the right to bring proceedings in the courts of your country of residence, or to use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
